Germany - Overview information
It contains overview information for Germany regarding the current status of implementation of Directive 2002/91/EC in buildings. It includes comparisons between the EU guidelines and the German legislation. EnEV (German energy regulation) is also presented.

Abstract-Energy Performance of Building Directive-EU Directive
A goal of the guideline is the improvement of the total energy efficiency of buildings.
· Within the European Union a uniform framework for ecological measures in buildings is to be created regarding the energy efficiency, transparency for the advantage for owners and users increased.
· According to regionally differentiated methods the thermal insulation in addition, the increasing meaning of the heating systems are to be considered connected with the use of renewable sources of energy and the building construction.
Conversion to Germany
· In Germany the building guideline is converted by the amended energy saving regulation EnEV 2006.
· It will be expected that the EnEV 2006 at the earliest at the beginning of 2007 is converted.
Details
· The guideline specifies criteria for the collective evaluation of the energy efficiency of buildings: additionally to the thermal insulation also different factors, e.g. heating systems and air conditioning systems, the use of renewable sources of energy and the type of construction of the building are included.
· At larger renovations of existing buildings with a total effective area of more than 1,000 m² the measures must fulfill an energetic minimum requirements.
· At new buildings with a total effective area of more than 1,000 m² the employment of CO2 poor supplying systems is to be considered (decentralized power supply systems on the basis of renewable sources of energy, KWK, district/zone heating or district/zone cooling, heat pumps).
· The guideline demands inspections and efficiency controls at boilers and air conditioning systems starting from a specific achievement by independent technical personnel.
· By building, by sale or by renting of buildings (new building and existence) a document of identification is to be submitted over the total energy efficiency.
· In large public buildings (total effective area of more than 1,000 m²) this document of identification must be presented in a well visible place for the public.
New building and Refurbishment
While in Germany for new buildings according EnEV a power requirement document of identification already must be issued (Total primary energy demand), the evaluation of the energetic quality of existing buildings took place so far on voluntary basis in the context of the energy counselling. The guideline prescribes now an energy document of identification also by renting or by sales of existing buildings.
Requirement or consumption?
In principle energy documents of identification can define either the power requirement or the energy consumption of the building. The requirement calculation make normative assumption for climate and use and forms so a “calculated consumption”, while the value consumed illustrates the user behaviour and climatic influences. The information content of both variants is not identical.
Modernisation references
According to European Union guideline economical and economic measures are attached to the energy document of identification. These measures are not binding, but serve only the information.
Independent technical personnel
Who may issue energy documents in Germany, the energy saving regulation 2006 (EnEV) will specify.
· New buildings: Regulation remains, is in the responsibility of the countries.
· Existing buildings: Ministerial draft plans specific occupational education as well as an auxiliary qualification.
o Non-residential building: University graduate.
o Residential building: additionally craftsmen and technicians.
Auxiliary qualifications
General one of the following auxiliary qualifications is to be proven:
· Major field of study in the range of energy-saving building or an at least two-year professional experience in substantial build or configuration-technical fields of activity of the building construction.
· Successful advanced training in the field of energy-saving building, key aspects of the advanced training is prescribed in the EnEV.
· Authorization to present building documents.
Temporary agreement
The following temporary agreements are intended:
· For residential buildings which are built before 1965: 6 months after the entry into force
· For residential buildings which are built after 1965: 18 months after the entry into force
· For non-residential buildings: 24 months after the entry into force
Existing power requirement documents of identification in accordance with EnEV and heat requirement documents of identification in accordance with thermal insulation regulations are recognized.

Issuing and use of energy documents of identification
1) If a building is constructed or..., is the owner an energy document of identification ... to be issued. The owner has to submit the energy document of identification to the responsible authority, if they demand.
2) If a building is to be sold..., (sense with renting, farm lease, leasing) the salesman has to make the prospective buyer the energy document of identification accessible. The energy document of identification refers to the building.
3) For buildings with more than 1000 m² net surface area.... for a large number of humans public services..... The owner has to put the energy document of identification out.
Principles of the energy document of identification
1) Energy documents of identification are on the basis of the calculated demand or the measured energy consumption…. to issue…
4) Energy documents of identification must conform in content and structure the samples….. They are to be signed by the exhibitor…. personally.
5) Energy documents of identification are to be issued for a validity period of ten years....
Issuing on the basis of the demand
2) The owner can make the necessary building data available; the issuer may not include these to his calculation, as far as they give justified cause for doubts about their correctness
Issuing on the basis of the energy consumption
1) weather-settled energy consumption. Supply of the building -including consumption data by the owner possible.
2) Surface reference by residential buildings is the building effective area; Surface reference by non-residential buildings is the net surface area.
3) For the determination of energy consumption characteristic values at least three sequential accounting periods are to include.

5) Increase of the energy consumption characteristic value
· Residential building with 3-5 flats: 15 kWh/(m²xa),
· Residential building with 1-2 flats: 30 kWh/(m²xa)
Recommendations for the improvement of the energy efficiency
1) Are measures for economical improvement of the energetic characteristics of the building possible the exhibitor of the energy document of identification has appropriate, accompanying recommendations to the owner …. to issue (modernisation recommendations).
If modernization recommendations are not possible, the exhibitor has to communicate in writing this to the owner.
